Terms and Conditions

Definitions:

Facility: The Mobile Banking facility granted by Koilege SACCO to the holder(s) of KOILEGE SACCO account or services as determined by the SACCO from time to time.

The Society: Any branch of Koilege SACCO in Kenya with which the Member’s Account is maintained.

Member: The person who holds an Account with Koilege SACCO.

Service Providers: Includes but is not limited to MSPs, organizations, or individuals whose services the SACCO uses in relation to mobile banking Services in any capacity.

PIN: The 4-digit number provided to the Member by Koilege SACCO for authentication/verification of his/her identity.

Alerts: Customized messages sent either by short messaging serving/text (SMS) over the Member’s mobile phone, email, fax, or any other modes of communication in relation to MOBILE Service access.

These terms and conditions, together with the application made by the Member and as accepted by Koilege SACCO, shall form the contract between the Member and Koilege SACCO. By registering for the Facility, the Member acknowledges and accepts these terms and conditions.

Terms & Conditions

The Member:

The Member shall apply to Koilege SACCO for the use of the Facility through forms as prescribed by the Society from time to time.

The Member's application for Mobile banking services shall be accepted only after authentication of the member through any mode of verification as may be stipulated by the Society.

By making a request for a transaction from his/her mobile phone in the format prescribed by the Society, the Member authorizes the Society to access all its accounts linked to Mobile banking services for effecting the transaction.

The Society shall endeavor to carry out the instructions promptly but shall not be responsible for any delay due to operational failures or requirements of law.

Mobile banking services may be terminated or suspended by the Society for any reason, with or without notice to the Member.

Requests for transactions made through the mobile are irreversible, and the Member should take sufficient care while making them.

The Member shall be solely responsible for the accuracy and authenticity of the information provided.

In case of errors in the information provided by the Society, the Member shall advise the Society as soon as possible.

The Member is solely responsible for protecting his/her PIN and mobile phone, and Koilege SACCO shall not be liable for unauthorized use.

Koilege SACCO will endeavor to maintain the secrecy and confidentiality of member’s accounts but shall not be liable for compromises due to breaches.

The Society:

Koilege SACCO may send messages to the members regarding products/services or any other promotional message.

Members can request termination of Mobile banking services by visiting the branch or sending an SMS as prescribed.

Koilege SACCO may withdraw or terminate the service temporarily or permanently without prior notice.

The Society may change terms and conditions at any time as it deems fit.

Any dispute shall be subject to the exclusive jurisdiction of Kenyan laws.

Notices from Koilege SACCO to the member may be made in such manner and by such means of communication as the Society deems fit.

MOBILE LOAN Account Terms and Conditions:

As a holder of the mobile loan account, you may apply for a loan from the SACCO using the MOBILE LOAN Menu on your Equipment.

Loan applications shall be appraised according to the applicable loan appraisal processes of the SACCO.

The Sacco reserves the right to approve or decline loan applications at its sole discretion.

The proceeds of the Loan shall be credited to your MPESA Account subject to any deductions.

You shall repay the Loan within the stipulated time as determined by the Sacco.

Interest rates are subject to change at the Sacco’s sole discretion.

Any outstanding loan amount and accrued interest and penalties may be recovered from other savings accounts held by you in the Sacco.

The Sacco reserves the right to vary the terms of the Loan including the interest payable thereon.

The Sacco may disclose details or information pertaining to your MOBILE LOAN Account to Credit Reference Bureaus as required by law.

Disclaimer of Liability

Koilege SACCO is not liable for any error or omission in the services provided by any Mobile or third-party service provider.

Koilege SACCO does not warrant the confidentiality or security of messages transmitted through the Facility.

Koilege SACCO shall not be liable for any loss or damage due to the unavailability of the Facility.

The Member shall indemnify and keep Koilege SACCO safe from any loss arising from the use of the Facility.

Indemnity:

The Member agrees to indemnify and hold Koilege SACCO harmless for any losses occurring as a result of the Member permitting others to use the Facility.
